Terms of Service

Banyan Camera is operated by Entheos LLC, a limited liability company organized under the laws of the State of Indiana, United States of America ("we", "us", "our"). When you use Banyan Camera, you are entering into an agreement with Entheos LLC.

By creating an account or otherwise using Banyan Camera (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. You must be at least 13 years old (or the minimum age required in your country) and, if accepting on behalf of an organization, have authority to bind it.

Banyan Camera is a shared cloud camera and album service. You can create albums, capture and upload photos and videos from the app, and invite others to contribute via link. We may change, suspend, or discontinue features at any time.

You're responsible for activity on your account and for keeping your credentials secure. You must provide accurate information and keep it up to date.

You retain ownership of photos, videos, and other content you upload. You grant Entheos LLCa limited, worldwide, non-exclusive license to host, store, transmit, display, and process your content solely to operate and improve the Service. You are responsible for having the rights to anything you upload.

You agree not to: (a) use the Service unlawfully; (b) upload content that is illegal, infringing, harmful, or that you do not have rights to share; (c) commit fraud, send spam, or harass others; (d) interfere with the Service's security or integrity (no probing, scraping, malware, or circumventing technical limits); or (e) reverse engineer, resell, or redistribute the Service. We may remove content or suspend accounts that violate these terms.

Entheos LLC retains all right, title, and interest in the Service, including its software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your selected plan.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency, invoicing, and related mechanics are governed by Paddle's Checkout / Buyer Terms. Paid plans bill in advance on a recurring basis until cancelled. Cancellation takes effect at the end of the current billing period. Refunds are handled under our Refund Policy.

You can delete your account at any time from the profile page. We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On deletion, your content is removed from live systems within 30 days.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not guarantee the Service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, Entheos LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, revenue, or profits. Our aggregate liability arising out of or relating to the Service will not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

You agree to indemnify and hold harmless Entheos LLC from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of applicable law or any third-party rights.

We may update these Terms from time to time. Material changes will be communicated in the app or by email. Continued use after changes means you accept the updated Terms.

These Terms are governed by the laws of the State of Indiana, United States of America, without regard to conflict-of-law principles. The exclusive venue for any dispute is the state or federal courts located in Indiana, USA, and you consent to personal jurisdiction there.
